Secure Health, Inc. Terms of Sale, Services, Warranty & Returns Policy

TERMS AND CONDITIONS OF SALE
One-year limited product warranty –
Secure Health, Inc. is the authorized distributor for services and products as described on the specific, authorized product quote, bill of sale, billing authorization, and/or sales invoice. Secure Health, Inc. is not an equipment manufacturer. Secure Health, Inc. and it's authorized representatives adhere to the terms and conditions of the original equipment manufacturer.
Secure Health, Inc., through the original product manufacturer/s, warrants its products to be free of defects due to faulty material or workmanship and, when properly used, will perform in accordance with applicable specifications for 12 months from date of shipment. Normal wear and tear and/or user error are not considered a defect in material or workmanship. If a component of a system is deemed by Secure Health, Inc. to be covered by the manufacturer's warranty, that defective component will be repaired or replaced per the warranty terms. A defective component does not indicate that the entire system will be repaired or replaced per the warranty terms if the rest of the components are deemed to be functioning properly.
By purchasing product/s and service/s including over-read services, and/or training and installation from Secure Health, Inc. and/or it's authorized representatives, customers agree to the terms and conditions of sale, billing authorization and warranty and returns policies.
All sales are final.
All services rendered, including over-read services, training and installation, etc. are subject to payment as agreed on the billing authorization and sales invoice/s.
By submitting VNG tests for over-read services, customers are subject to payment as agreed on the billing authorization and sales invoice/s. The prescribing/providing physician, as well as the clinic or medical entity are liable for payment of charges incurred for over-read services.
Cancellation of over-read services, training/installation and other services must be given in writing.
Payment for any and all over-read services and/or other services including training and installation is due in full for all work that has been incurred per the terms of the billing authorization and sales invoice.
Secure Health, Inc.'s liability shall be limited to repair or replacement of defective materials during the warranty period and will be at Secure Health, Inc.´s discretion when returned prepaid to its Indiana office. The warranty does not cover damage caused by accident, abuse, neglect, willful or improper use or installation, including but not limited to acts of God, natural disasters, smoke, fire, or water damage. Failure to properly use surge protectors will void the warranty.
Secure Health, Inc. products must be installed, maintained and operated in accordance to the recommendation of the original equipment manufacturer, Secure Health, Inc. and the product manual of instructions. Failure to properly use surge protectors will automatically void the warranty. Failure to properly secure product software from electronic issues such as computer viruses, malware, ransomware or other similar issues related to firewall and security will void the warranty.
Computers supplied by Secure Health, Inc. to be used in conjunction with products are subject to the original computer manufacturer´s guarantee and warranties. All warranty claims relating to the computer operation, not relating to the product's software, should be addressed by the customer directly with the computer manufacturer adhering to its terms and conditions.
Not Responsible for Data Storage or Backups
IMPORTANT: YOU, THE CLIENT ARE RESPONSIBLE FOR COMPLETING REGULAR AND FREQUENT BACK-UPS TO YOUR PRODUCT TEST RESULTS. LOST HARD DRIVE DATA IS NOT INCLUDED IN EITHER THE SECURE HEALTH, INC WARRANTY OR YOUR COMPUTER MANUFACTURER'S WARRANTY. ANY AND ALL COSTS ASSOCIATED WITH DATA RETRIEVAL FROM A CRASHED OR DAMAGED HARD DRIVE IS THE SOLE RESPONSIBILITY OF THE CUSTOMER
Extended Warranties
Extended warranties may be purchased by the customer at the time of the sale if available. As an example, the first year is included in the original purchase price. If a second year of warranty is desired and the additional fee is paid, the customer has a total of two years of warranty. The extended warranty follows the same terms and conditions as explained herein. Extended warranties may or may not be available, please ask for a quote if you need additional information.
Product Returns
Should a product have a warranty issue, the product must be returned pre-paid to Secure Health, Inc. for warranty inspection and consideration. Should a warrantable event be verified, the product will be repaired or replaced at no charge to the customer per Secure Health, Inc.´s warranty policy.
Product repairs determined not a warrantable event will require customer pre-authorization to repair or replace the product at customer’s expense. Secure Health, Inc. will issue a written repair estimate for the entire repair or replacement to the customer and the customer must authorize those repairs or replacement in advance and in writing with payment being made prior to any repairs being started.
All sales are final. There are no returns, for any reason, unless authorized in writing by Secure Health, Inc. Corporate CEO only. Should a product return be accepted, restocking and handling fees will apply and will be determined by the CEO only.

Warranty Return Protocol
1. Contact Secure Health, Inc. customer service at 1-260-804-4041 and request the Warranty and Repairs Coordinator for the Returned Goods Authorization (RGA) number. Warranty claims will require the following information before a RGA number can be issued:
--Product/model number
--Serial number
--Invoice number
--Date of purchase
--Date, method and amount of payment
--Reason for return, please be specific
NOTE: Additional information may be required to process your request.
2. If a product replacement is required prior to Secure Health, Inc. receiving your return, the products being sent will be invoiced to your account until the warranty process is completed. Product replacement during the warranty process is subject to availability and other conditions, variables. Client assumes all liability for damage, accidental or otherwise, to loaner equipment and agrees to properly reimburse for any damage caused to the equipment during transit or while in possession of the loaner equipment. Client agrees to promptly return loaner equipment in the same condition as when received in a timely manner.
3. Once given, an RGA number all corresponding inquiries, paperwork and shipping boxes will require this number. Secure Health, Inc. reserves the right to refuse returns without an RGA number.
4. Product(s) being returned for warranty inspection or other reasons must be carefully and properly packaged for shipment. Items received damaged or improperly packaged may not be repairable. Client assumes responsibility for properly packaging the items being returned/shipped.
5. Upon receipt of your warranty return and all of the warranty conditions are met, the product will be repaired and returned to you within a reasonable and customary amount of time. A general estimate of the timeline for warranty repairs will be provided once available, but there is no explicit or implied guaranteed timeline for warranty repairs.

Failure to Pay
Failure to pay for products and services requested and incurred on behalf of a client, customer, providing physician and/or medical entity, including over-reads, training and installation will be subject to discontinuation of services until the account balance is paid in full. Failure to make payments without proper notification of cancellation, may result in further collection action for services incurred. Failure to make payments for products received or services for products and services requested and incurred on behalf of a client, customer, providing physician and/or medical entity, may result in further collection action. Secure Health, Inc. will have full discretion for unpaid accounts and will take the necessary action to collect any unpaid balances.
BILLING / CODING

SECURE HEALTH, INC. VNG OVER-READ SERVICES
Secure Health, Inc. has established a VNG over-read service for clients. Secure Health, Inc. contracts with independent, third party MD's and AuD's to provide over-read services to clients. The role of Secure Health, Inc. is that of a portal only. Secure Health, Inc. does not offer any medical or treatment advice, nor recommend any diagnosis for any patient and is not responsible for the over-read, diagnosis or treatment of any patient. Secure Health, Inc. is not responsible for the vetting nor qualifications of the independent, third party MD's and AuD's who provide their over-read services to clients.
Over-reads are in no way intended to be a diagnosis or suggested treatment for any patient. The independent, third party MD's and AuD's only interpret the data generated by the clients who submit VNG tests to them. Over-reads do not take into account any patient history or patient exams. An over-read only takes into account the plotted results of the submitted VNG test(s) and describes those results.
It is the sole responsibility of the providing physician(s) to take the results from the over-read(s), patient history and patient exam to make a final diagnosis and treatment plan.
It is the sole responsibility of the providing physician(s) and their clinics to comply with all federal, state and local laws regarding their own billing/coding/reimbursements.
Secure Health, Inc. and it's authorized representatives are in no way responsible or liable for Billing / Coding / Reimbursements for any of the services and/or products we sell or service.
By completing the billing authorization and submitting VNG tests for VNG over-reads indicates the providing physician agrees to the terms and conditions of the over-read services.
Cancelling over-read services, with or without proper notice, does not release the providing physician and clinic from account balances for service work incurred on their behalf.
Failure to pay Secure Health, Inc. for over-read services may result in further collection action for unpaid account balances.
